Terms of Service

1) Acceptance of Terms

By accessing or using Moment, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Platform.

2) Eligibility (18+)

You must be at least 18 years old to access or use the Platform. By creating an account or using Moment, you represent and warrant that you are 18+ and legally able to enter into binding agreements.

3) Platform Role: Listing-Only, Neutral Marketplace

Moment is a neutral classifieds/listing marketplace that enables users to publish listings and communicate.

We do not own, store, handle, inspect, verify, deliver, clean, authenticate, or guarantee any dress or item listed on the Platform.

Any rental, sale, fitting, handover, cleaning, delivery, payment, refund, return, damage, dispute, or complaint is strictly between users. We are not a party to any transaction or arrangement between users and have no obligation to enforce, mediate, or resolve disputes.

4) User Accounts

You are responsible for:

• maintaining the confidentiality of your account access,
• all activity that occurs under your account,
• ensuring your account information is accurate.

We may suspend or terminate accounts for violations of these Terms or for safety and integrity reasons.

5) Listings and User Content

“User Content” includes photos, videos, listing text, dimensions, prices, profile content, and messages sent via in-app chat.

You are solely responsible for your User Content and any consequences of posting it, including accuracy, legality, and rights ownership.

5.1 User Content Warranties

You represent and warrant that:

• you own or have all necessary rights and permissions to upload your User Content and grant the licences in these Terms,
• your User Content does not infringe any third-party rights (copyright, privacy, trademark),
• your listings are accurate to the best of your knowledge.

6) AI-Enhanced Images and No Guarantee

Listings may include images that are enhanced, edited, upscaled, or otherwise modified using AI or other tools to improve quality or presentation.

Images on the Platform are illustrative only and may not reflect the item’s exact colour, fabric texture, fit, condition, size, or appearance in real life. Users rely on listing images and descriptions at their own risk.

If the Platform includes AI-generated representations (including simulated model imagery), such representations are not a guarantee of actual fit, drape, or appearance.

7) Try Before Renting (User Advisory)

We strongly recommend renters inspect and try an item (or otherwise verify size and condition) before confirming any rental or handover. This is guidance only. The decision and responsibility remain entirely with users.

8) Licence to Use Listing Photos for Marketing

You retain ownership of your User Content.

By uploading or submitting User Content to Moment, you grant Hola Mundo Graphic Design a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to host, store, reproduce, modify (including AI enhancement), adapt, publish, translate, display, and distribute your User Content for operating, promoting, and improving the Platform, including use in marketing and advertising materials (digital and print), social media, app store pages, and promotional campaigns.

This licence continues for as long as the content remains on the Platform and for a reasonable period after removal for backup, compliance, legal, and marketing archive purposes.

We will not intentionally include your private contact details in marketing materials without your consent.

9) In-App Chat: Safety Review and Improvement

If the Platform provides messaging features between users, to maintain safety, prevent abuse, comply with law, and improve the Platform, we may review, scan, or analyse messages using automated tools and, in limited cases, manual review.

We may use aggregated and/or de-identified insights from messages to improve features, customer experience, and service quality.

Marketing Use of Chat Content: If we use chat content for marketing, we will use it in anonymised form (removing names, phone numbers, and other identifying details) unless we obtain your explicit consent.

10) Prohibited Content and Conduct

You agree not to:

• post illegal, misleading, fraudulent, or infringing content,
• post obscene or sexually explicit content,
• post images of minors, or content exploiting minors,
• harass, threaten, or abuse others,
• attempt to circumvent safety measures or platform rules,
• scrape or copy Platform content at scale without permission.

We may remove content and suspend accounts at our discretion.

11) Third-Party Services

The Platform may contain links or integrations with third parties. We do not control them and are not responsible for their services or content.

12) Disclaimers

The Platform is provided “AS IS” and “AS AVAILABLE.” We make no warranties regarding listings, users, items, availability, accuracy, or outcomes.

We do not guarantee that:

• listings are accurate,
• users are trustworthy,
• items are safe or suitable,
• any transaction will be completed.

13) Limitation of Liability

To the maximum extent permitted by law, Hola Mundo Graphic Design is not liable for any direct or indirect damages arising from:

• user content,
• user conduct,
• user transactions,
• reliance on listings or images,
• disputes between users.

If liability cannot be excluded, our total liability is limited to the amounts you paid us (if any) in the 30 days preceding the event giving rise to the claim, or BHD 50, whichever is lower.

14) Indemnity

You agree to indemnify and hold harmless Hola Mundo Graphic Design from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from:

• your use of the Platform,
• your User Content,
• your transactions with other users,
• your violation of these Terms or any law.

15) Termination

We may suspend or terminate your access to the Platform at any time if we believe you violated these Terms or pose risk to the Platform or its users.

16) Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Bahrain. Any disputes shall be subject to the courts of the Kingdom of Bahrain, unless mandatory law requires otherwise.

17) Changes to These Terms

We may update these Terms. The latest version will be posted with an updated Effective Date. Continued use means acceptance.
